(1) Introduction

These General Terms and Conditions of Purchase govern the use of the website explorahorseboots.com, owned by Horse Solution SL (hereinafter under the trade name ‘Explora Boot’).

Horse Solution, S.L.U., is a single‑member limited liability company with its registered office in El Cabañon, postal code 33529, Nava, Asturias (Spain), with Tax ID B‑74438037, and registered in the Commercial Registry of Asturias, Volume 4290, Book 0, Page 15, Sheet AS‑52555.”

By using the online store services of Explora Boots, the customer is deemed, in all cases, to accept the General Terms and Conditions of Purchase as published on our website.

We recommend reading the General Terms and Conditions before making a purchase.

(2) Order Process

“The advertising of products on our website constitutes an ‘invitation to treat’, and your order for products constitutes a contractual offer. No contract will come into force between you and us until we accept your order in accordance with the procedure detailed below.

To enter into a purchase contract with us for our products, you will need to follow the steps below:

  2. Once you have selected your purchase, you will be able to review your order, including the total amount with taxes included, and then you will have the option to pay with PayPal or proceed to ‘Checkout’, where different payment methods will be offered to you;
  3. If you have chosen to pay with PayPal, you will be temporarily redirected to the PayPal website to confirm your payment method, before being returned to the Explora Boot website;
  4. If you do not complete the payment through PayPal, and if you are a new customer, you may create an account with us or proceed as a guest. If you are an existing customer, you must enter your login details;
  5. You must enter your billing details and delivery address, your preferred delivery method, and (unless you have already chosen PayPal) your preferred payment method. You are given a second opportunity to pay with PayPal at this stage;
  6. You will be able to review your order and modify your cart, or confirm your order by clicking ‘Place your order’;
  7. Depending on your chosen payment method, you will then be temporarily redirected to the Ruralvia or PayPal page so that Ruralvia or PayPal can process your payment. Once your payment has been completed, you will be returned to the Ex website. You may also choose to pay by direct bank transfer, in which case you simply need to ‘Place the order’;
  8. Once your order has been submitted, an order number will be assigned to you.

We will then send you an order confirmation email detailing the products you have ordered. Please note that this email does not constitute a confirmation or acceptance of your order by Explora Boot. If you have created an account with us, we will also send you a welcome email.

The acceptance of your order and the completion of the contract between you and us will only take place when the ordered products are dispatched to the address provided (at which point a shipping confirmation email will be sent), unless we have previously notified you by email that we do not accept your order or you have cancelled it in the meantime.

We will not provide a copy of these purchase terms specifically in relation to your order. We may update the version of these purchase terms on the Website from time to time, and we do not guarantee that the version you agreed to will remain accessible. Therefore, we recommend that you download, print, and keep a copy of these terms of sale for your records.

These terms will only be available in English and Spanish.

Before placing your order, you will have the opportunity to check whether you have made any mistakes by carefully reviewing your complete order during the order review stage of the checkout process. You may correct any input errors before placing your order by returning to the shopping cart (to remove products from your order) or returning to the product listings (to add products to your order). You must then restart the checkout process.

(3) The products

The characteristics of the products on our website are fully described on their respective individual product pages. There may occasionally be slight variations in product color when viewed on your computer or mobile device screen compared to its appearance in reality. Returns or exchanges will not be accepted on the basis that the color does not meet the customer’s expectations. Please note that product photographs and descriptions are for guidance purposes only.

We may update the product pages from time to time without notifying you of the changes. Therefore, when appropriate (for example, if you place an order), we advise you to print a copy of the product descriptions for your records.

(3.1) Availability

If the product you wish to purchase is out of stock or not listed in our product catalogue at the time of purchase, we will contact you as soon as possible to inform you of the possibility of obtaining it within a longer timeframe, or to proceed with cancelling the purchase.

In the event of a stock shortage, sales error, or any other circumstance that results in the product purchased being unavailable, Explora Boot will inform the customer of the situation so that the delivery period may be extended and/or a product with similar characteristics and price may be offered. In such cases, the customer will be notified of the issue and the proposed alternative.

All products and services offered for sale on this website are subject to availability and may be withdrawn at any time. The photos used are for illustration purposes only, and although we strive to be as accurate as possible, there may be slight differences compared to the actual product supplied.

We strive to maintain stock of all our active products. If our website states ‘Delivery in 1–3 days’, then we have that item in stock and it will most likely be allocated to you. Occasionally, our stock may already have been allocated to another customer. If this happens, the order placed first will have priority. If our website states ‘Delivery in 1–7 days’, then we do not currently have that item in stock, although it may arrive at any time. If we are out of stock of the item you selected and it is expected to take longer than estimated to ship, we will inform you of a revised estimated delivery date (subject to availability). You will always have the right to cancel your order if you prefer not to wait.

Some items may be shipped directly to you from our supplier so that you can receive your selected products as quickly as possible. This means you may receive your order in separate shipments, but you will not incur any additional shipping charges (unless otherwise agreed due to part of your order being out of stock at the time of purchase).

We cannot be held responsible for compensating you for any other loss you may suffer if we do not supply the goods.

(4) Precio y forma de pago

(i) Price

The total price of your products will be stated when you review your order and again once your order has been dispatched. All prices are in euros and include the relevant taxes for Spain where applicable. Prices do not include shipping or cash‑on‑delivery charges; these are shown to the customer at checkout. Any customs duties or import taxes due when your order arrives in the destination country are your responsibility.

While we strive to ensure that all prices on our website are correct, errors may occur. If we discover an error in the price of the goods you have ordered, we will inform you as soon as possible and give you the option to reconfirm your order at the correct price or cancel it. If we are unable to contact you, we will treat the order as cancelled. If you cancel and have already paid for the goods, you will receive a full refund.

On extremely rare occasions, the cost of the product may have increased but not yet been updated on the website, taxes may not have been included in the displayed price, or they may have changed. We will inform you immediately and before dispatch if this is the case, to ensure that you still wish to proceed with the purchase at the revised cost.

We reserve the right to refuse or cancel an order for products if it has been listed at an incorrect price due to a typographical error, or if the price from our suppliers, tax authorities, or customs offices was incorrect when our price was published. If you have already been charged, we will immediately refund the full amount you have paid (including shipping costs).

Product prices may change at any time, but such changes will not affect contracts that have already come into effect.

The user will be able to access their invoice in their account, if they wish, once the product has been delivered to the address provided.

(ii) Payment method

We accept at least three payment methods:

  • BANK TRANSFER: You may make the payment via a bank transfer from your usual bank or by depositing the amount directly into the account at the branch of your choice. Once the payment has been confirmed, your order will be shipped.
    If 7 business days have passed since the purchase was made and the payment has not been received, the order will be cancelled.
  • PAYPAL: You can pay with your Visa and/or Mastercard, or through your PayPal account. You simply need to log in, and you will be redirected to complete the purchase. The payment request will be issued before the order is delivered.

CREDIT CARD: You can pay with your VISA, Mastercard, Maestro, or Visa Electron card through the secure payment gateway.

(iii) Availability

If the goods cannot be supplied for any reason, we will contact you and you will not be charged for the items ordered. If payment has already been made, the cost (and shipping fees, if applicable) will be refunded to you immediately.

(5) Your guarantees

You guarantee that:

  • (A) you are legally capable of entering into binding contracts, and you have full authority, power, and capacity to agree to these terms of sale;
  • (B) the information provided in your order is accurate and complete; and
  • (C) you will be able to accept delivery of the products.

(6) Delivery Policy

We will do everything possible to ensure that the products are delivered to the delivery address indicated in your order.

(7) Risk and Ownership

The products will be at your risk from the moment they are delivered. Ownership of the products will pass to you only upon the later of the following events:

  • (A) the delivery of the products; and
  • (B) our receipt of full payment of all amounts owed for the products (including delivery charges).

Until ownership of the products has passed to you, you will hold them as our fiduciary agent and custodian. We reserve the right to recover payment for the products even if ownership has not yet transferred to you.

(8) Exchange Policy

Explora Boot offers you the possibility to exchange your purchased products for new ones within 14 days from the date you received your order, in case you need a size change. Below are the conditions regarding the size‑exchange guarantee:

  • If the customer has requested prior assistance in choosing the correct size, the boot exchange will be carried out free of charge, with no shipping costs.
  • If the customer has not requested assistance in choosing the correct size, they will be charged the shipping costs for the size exchange.

To proceed with this type of exchange, please contact us at info@explorahorseboots.com and you will receive a response as soon as possible with instructions on how to continue. No exchange will be processed unless it has been previously reviewed and approved by Explora Boot.

(9) Return and Refund Policy

We recommend ensuring that your horse’s hooves are completely clean and dry before trying on any of our products. We also suggest placing a plastic bag over the hoof to avoid damaging the inside of the boot, and setting the boot on a clean, dry surface — such as a towel — to prevent wear on the sole.

10) Consumers: Legal Rights

Nothing in these terms of sale affects any legal rights you may have as a consumer.

(11) Force Majeure

In this Section and in Section 12 (below), “force majeure event” means:

  • (A) any event that is beyond our reasonable control;
  • (B) the unavailability of raw materials, components, or products; and/or
  • (C) electrical failures, industrial disputes affecting third parties, government regulations, fires, floods, disasters, civil unrest, terrorist attacks, or wars.

When a force majeure event causes a failure or delay in fulfilling our obligations under these terms of sale, those obligations will be suspended for the duration of the force majeure event.

If we become aware of a force majeure event that results in, or is likely to result in, any failure or delay in fulfilling our obligations under these terms of sale, we will notify you immediately.

We will take reasonable steps to mitigate the effects of any force majeure event.

(12) Limitations of Liability

Nothing in these terms of sale will limit or exclude your liability for:

  • (i) death or personal injury caused by negligence;
  • (ii) fraud or fraudulent misrepresentation; or
  • (iii) any matter for which it would be unlawful to limit or exclude, or attempt to limit or exclude, liability.

Subject to this:

  • (A) we will not be liable for any loss arising from a force majeure event;
  • (B) we will not be liable for any defect in the products arising from reasonable wear and tear, intentional damage, accident, negligence by you or any third party, use not in accordance with the manufacturer’s instructions or recommendations, or any modification made by you or any third party.

(13) Cancellation Rights

  • 13.1 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (SI 2013/3134), you have the legal right to cancel your order up to 14 calendar days after the day you receive your goods (with the exception of any made‑to‑order items). You do not need to give us any reason for cancelling your contract, and you will not have to pay any penalty.

If you cancel your contract but we have already processed the goods for delivery, you must not unpack the goods when you receive them, and you must send them back to our contact address at your own cost and risk as soon as possible.
  • 13.5 Once you have notified us that you wish to cancel your contract, and we have received the goods or, if earlier, have received evidence that you have returned the goods, we will refund any amount debited by us from your credit or debit card within 14 calendar days.
  • 13.6 We may make a deduction from your refund for any loss in value of the goods supplied if that loss results from unnecessary handling by you (for example, using the goods before cancellation).

(14) Cancellation by Us

  • 14.1 We reserve the right not to process your order if:
    1. We have insufficient stock to deliver the goods you ordered;
    2. we do not deliver to your area; or
    3. One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
  • 14.2 If we do not process your order for any of the above reasons, we will notify you by email and re‑credit to your account any sum deducted by us from your credit or debit card as soon as possible, and in any event within 14 days.

(15). If there is a problem with the goods

We treat all of your personal information collected in connection with your order in accordance with the terms of our privacy policy; your use of our website will be subject to our website terms of use.

Contracts under these terms of sale may only be amended in writing and signed by both you and us. We may revise these terms of sale from time to time, but such revisions will not affect the terms of any contracts we have already entered into with you.

If any clause of these terms of sale is found invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect, and such invalid or unenforceable provisions, or parts of them, will be deemed deleted.

A waiver of any provision of these terms of sale, whether by conduct or otherwise, on one or more occasions, will not be deemed or construed as a further or continuing waiver of that provision or of any other provision of these terms of sale.

You may not assign, charge, subcontract or otherwise transfer any of your rights or obligations arising under these terms of sale. Any attempt to do so by you will be void and of no effect. We may assign, charge, subcontract or otherwise transfer any of our rights or obligations arising under these terms of sale at any time — provided that you are a consumer and that such action does not reduce the guarantees that benefit you under these terms of sale.

Each contract under these terms of sale is made for the benefit of the parties to it and is not intended to benefit, or be enforceable by, any other person. The right of the parties to terminate, rescind, or agree to any amendment, variation, waiver, or settlement under such contracts is not subject to the consent of any person who is not a party to the relevant contract.

Subject to the first paragraph of Section 12, these terms of sale contain the entire agreement and understanding between the parties regarding the purchase of products from our website and supersede all prior agreements and understandings between the parties relating to the purchase of products from our website; and each party acknowledges that no representations have been made by or on behalf of the other party in connection with the purchase of products from our website other than those expressly set out in these terms of sale.

These terms of sale shall be governed by and construed in accordance with Spanish law, and the courts of Asturias (Spain) shall have non‑exclusive jurisdiction to settle any dispute arising in connection with these terms of sale.

All equestrian activities are potentially dangerous; always check the equipment before each use to identify any signs of wear or damage. Do not use the equipment if it shows signs of wear or damage. If the equipment is still within the warranty period, you must stop using it and return it to Explora Boot for repair or replacement.
